O-1 Visa

For individuals with extraordinary ability in the sciences, arts, education, business, athletics, film, or television.

If you possess extraordinary ability or achievement recognized nationally or internationally, you may qualify for an O-1 visa to work temporarily in the United States in your field of expertise.

What Is the O-1 Visa?

The O-1 visa is for individuals with extraordinary ability in the sciences, education, business, athletics, arts, film, or television, demonstrated through sustained national or international acclaim. It is divided into two subcategories: O-1A and O-1B.

O-1A: Sciences, Education, Business, and Athletics

For individuals with extraordinary ability in the sciences, education, business, or athletics. Applicants must meet at least 3 of the following criteria (or have received a major internationally recognized award, such as a Nobel Prize):

  • National or international awards for excellence
  • Membership in associations that require outstanding achievement
  • Published material about you in professional publications or major media
  • Having judged the work of others in your field
  • Original contributions of major significance to your field
  • Authorship of scholarly articles
  • Employment in a critical or essential capacity for distinguished organizations
  • High salary or other remuneration significantly above the field average

O-1B: Arts, Motion Picture, and Television

For individuals with extraordinary achievement in the arts, or extraordinary recognition in motion picture or television production. Applicants need a recognized nomination or award (such as an Oscar, Emmy, Grammy, or Tony), or must meet at least 3 criteria similar to the O-1A category, adapted to artistic achievement: critical recognition, participation in prestigious productions, significant remuneration, among others.

Application Process

  • Initial consultation to assess eligibility
  • Gathering documentary evidence of achievements
  • Obtaining a written advisory opinion from a peer group or union in your field
  • Filing Form I-129 petition with USCIS
  • Approval and consular visa application or adjustment of status
  • Entry to the U.S. or change of status
  • Beginning authorized employment

Support Personnel (O-2) and Family Members (O-3)

Essential support personnel accompanying an O-1 beneficiary may qualify for an O-2 visa. A spouse and unmarried children under 21 may obtain derivative O-3 status, though they are not authorized to work.

Benefits of the O-1 Visa

  • Nonimmigrant work status
  • Valid for up to 3 years, with extensions in 1-year increments
  • No single-employer requirement; may work for multiple sponsors with separate petitions
  • No annual numerical cap
  • May apply for permanent residency while maintaining O-1 status

Processing Times

Typically 2 to 4 months, with premium processing available to expedite USCIS review.
